Terms Of Use AND LIABILITY AGREEMENT
This agreement ("Terms") governs the services provided by David D’Amore, trading as Dave Drums (“we,” “us,” or “our”), including services delivered by David D’Amore and his employees, contractors, volunteers, or authorised representatives. Our services include:
In-person and online lessons: Individual and group sessions, membership plans, and lesson packs.
Learning platforms: Online subscriptions, online courses, educational materials and related content through soundslice.com or other integrated third-party platforms.
Website use: Access to davedrums.com.au and its educational materials.
Events and promotions: Participation in workshops, showcases, recitals or similar activities.
⚠️ These Terms are numbered and divided into the sections below. Click each section to expand and review the details carefully. By enrolling in lessons, subscribing to services, using our services, or accessing our platform, you confirm that you have read, understood and agreed to these Terms. For minors, a parent or guardian must agree on their behalf and ensure compliance. Updates to these Terms will be communicated via email, and continued use constitutes acceptance of any changes.

1.1 Assumption of Risks
Participation may involve risks (e.g, injury or property damage), which you accept voluntarily.1.2 Release and Discharge
We are not liable for injuries or damages incurred during lessons, events, or equipment use, including those caused by representatives acting on our behalf.1.3 Indemnification
You agree to indemnify us and our representatives against claims related to participation.1.4 Medical Emergencies
We may arrange medical assistance in emergencies, at your cost.1.5 Media Use
You grant us permission to use photos, videos, or recordings taken during lessons or events for promotional purposes. -
2.1 Bookings and Payments
Lessons are paid in advance through online booking; cash is accepted by arrangement.2.2 Memberships
Weekly memberships include 1 lesson per week and renew automatically until cancelled, with a minimum term of 5 weeks. Pause or cancel via email or website.2.3 Lesson Packs
Includes 5 consecutive weekly lessons. May be rescheduled within 6 days of the original lesson (if notified 24+ hours in advance), subject to availability. If no suitable reschedule times are available or you cannot attend, the lesson will be forfeited.2.4 Group Lesson Adjustment Fee
Solo enrolments in group lessons convert to private lessons. Either an adjustment fee will be applied, or lesson duration can be reduced to avoid the fee. Please notify us in advance if you prefer this option.2.5 Cancellations and Refunds
Lessons may be rescheduled with 24+ hours notice. Lessons cancelled with less than 24 hours notice or no-shows will be charged in full, with no refunds or make-ups. Teacher cancellations will be rescheduled or credited. Refunds will not be issued for missed, expired, or completed lessons.2.6 Student Conduct
We strive to create a respectful, supportive environment. Students are expected to respect the teacher, fellow students, and equipment. Disruptive conduct may result in lesson termination, with damages covered by the student or guardian. -
3.1 Subscriptions
OLP access is billed monthly and renews automatically until cancelled. Payments are final, and refunds are not available. In the case of prolonged technical disruptions to the OLP, refunds may be issued at our discretion.3.2 Suspensions and Cancellations
OLP Subscriptions cannot be paused. To cancel, submit a request via email or the website; access ends immediately upon cancellation.3.3 Content Use
Materials are for personal use only and protected by copyright. Reproduction, distribution, or commercial use without prior written consent is prohibited. -
4.1 No Guarantees
Our services are provided "as is" without guarantees of specific results or improvements, as progress depends on individual effort and circumstances beyond our control.4.2 Force Majeure
We are not liable for delays caused by events outside of our control (e.g., natural disasters, government actions, technical failures).4.3 Disputes
These Terms are governed by the laws of Queensland, Australia. Disputes unresolved through negotiation proceed to mediation or court in Queensland.4.4 Severability
If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.4.5 Termination
We reserve the right to terminate access for breaches, including non-payment or inappropriate conduct.
